Am facut mai jos o selectie de articole care, in opinia mea, produc cele mai notabile modificari. Pentru o intelegere completa recomand si lectura intregii\u00a0<a href=\"http:\/\/legislatie.just.ro\/Public\/DetaliiDocument\/203233\" target=\"_blank\" rel=\"noopener\">legi a asociatiilor de proprietari<\/a>.<\/p>\n<p style=\"text-align: justify;\">Cea mai importanta modificare pe care o aduce legea se refera la statutul administratorilor de imobile, asa cum am descris in articolul despre\u00a0<a href=\"https:\/\/blog.aviziero.ro\/din-industrie\/un-scenariu-prost-pentru-administratorii-de-imobile\/\" target=\"_blank\" rel=\"noopener\">atestarea administratorilor de imobile<\/a>.<\/p>\n<p class=\"p3\" style=\"text-align: justify;\"><span class=\"s1\"><b>Capitolul I\u00a0Dispozi\u021bii generale, defini\u021bii<\/b><\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s1\"><b>Sec\u0163iunea 1\u00a0Defini\u021bii<\/b><\/span><\/p>\n<p class=\"p5\" style=\"text-align: justify;\"><span class=\"s1\"><b>Articolul 2<\/b><\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s1\">\u00cen sensul prezentei legi, termenii \u0219i expresiile de mai jos au urm\u0103toarele semnifica\u021bii:<\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s2\"><b>b)<\/b><\/span><span class=\"s1\">\u00a0ansamblu reziden\u021bial &#8211; imobilul format din teren pe care sunt amplasate izolat, \u00een\u0219iruit sau cuplat locuin\u021be sau locuin\u021be \u0219i construc\u021bii cu alt\u0103 destina\u021bie, \u00een care exist\u0103 propriet\u0103\u021bi comune \u0219i propriet\u0103\u021bi individuale;<\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s2\"><b>c)<\/b><\/span><span class=\"s1\">\u00a0asocia\u021bie de chiria\u0219i &#8211; form\u0103 de asociere autonom\u0103 \u0219i f\u0103r\u0103 scop lucrativ a chiria\u0219ilor dintr-un condominiu \u00een scopul reprezent\u0103rii intereselor lor \u00een raporturile cu proprietarii, precum \u0219i cu alte persoane juridice sau persoane fizice;<\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s2\"><b>f)<\/b><\/span><span class=\"s1\">\u00a0certificat de calificare profesional\u0103 &#8211; actul care dovede\u0219te calificarea profesional\u0103 a persoanelor fizice pentru a \u00eendeplini ocupa\u021bia de administrator de condominii, \u00een conformitate cu legisla\u021bia privind \u00eenv\u0103\u021b\u0103m\u00e2ntul superior sau privind formarea profesional\u0103 a adul\u021bilor;<\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s2\"><b>j)<\/b><\/span><span class=\"s1\">\u00a0conven\u021bie individual\u0103 de facturare &#8211; act juridic \u00eencheiat \u00eentre un furnizor de servicii de utilit\u0103\u021bi publice, asocia\u021bia de proprietari \u0219i un proprietar individual din condominiu, anex\u0103 la contractul de furnizare a serviciilor de utilit\u0103\u021bi publice \u00eencheiat \u00eentre un furnizor de servicii de utilit\u0103\u021bi publice \u0219i asocia\u021bia de proprietari, prin care se stabilesc condi\u021biile de furnizare, utilizare, facturare \u0219i plat\u0103 a serviciilor de utilit\u0103\u021bi publice furnizate la nivel de utilizator individual din cadrul unui condominiu;<\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s1\"><b>Sec\u0163iunea a 2-a\u00a0Dispozi\u021bii generale<\/b><\/span><\/p>\n<p class=\"p5\" style=\"text-align: justify;\"><span class=\"s1\"><b>Articolul 3<\/b><\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s1\">(3)\u00a0\u00cen sensul\u00a0<\/span><span class=\"s3\">art. 2 lit. h)<\/span><span class=\"s1\">, constituie condominiu:<\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s2\"><b>a)<\/b><\/span><span class=\"s1\">\u00a0cl\u0103diri cu mai multe locuin\u021be sau spa\u021bii cu alt\u0103 destina\u021bie \u00een care exist\u0103 propriet\u0103\u021bi individuale \u0219i propriet\u0103\u021bi comune;<\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s2\"><b>b)<\/b><\/span><span class=\"s1\">\u00a0cl\u0103diri multietajate; un tronson cu una sau mai multe sc\u0103ri din cadrul cl\u0103dirii multietajate \u00een cazul \u00een care se poate delimita proprietatea comun\u0103;<\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s2\"><b>c)<\/b><\/span><span class=\"s1\">\u00a0un ansamblu reziden\u021bial format din locuin\u021be \u0219i\/sau construc\u021bii cu alt\u0103 destina\u021bie, amplasate izolat, \u00een\u0219iruit sau cuplat, \u00een care exist\u0103 propriet\u0103\u021bi comune \u0219i propriet\u0103\u021bi individuale.<\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s1\"><b>Sec\u0163iunea a 3-a\u00a0Raportul dintre autorit\u0103\u021bile administra\u021biei publice \u0219i asocia\u021biile de proprietari<\/b><\/span><\/p>\n<p class=\"p5\" style=\"text-align: justify;\"><span class=\"s1\"><b>Articolul 10<\/b><\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s1\">(6)\u00a0Atestatul prev\u0103zut la\u00a0<\/span><span class=\"s3\">alin. (5)<\/span><span class=\"s1\">\u00a0se emite \u00een baza urm\u0103toarelor documente:<\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s2\"><b>a)<\/b><\/span><span class=\"s1\">\u00a0certificatul de calificare profesional\u0103 pentru ocupa\u021bia de administrator de condominii, conform prevederilor\u00a0<\/span><span class=\"s3\">art. 2 lit. f)<\/span><span class=\"s1\">;<\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s2\"><b>b)<\/b><\/span><span class=\"s1\">\u00a0cazierul judiciar care s\u0103 ateste c\u0103 nu a suferit nicio condamnare, prin hot\u0103r\u00e2re judec\u0103toreasc\u0103 r\u0103mas\u0103 definitiv\u0103, pentru o infrac\u021biune de natur\u0103 economico-financiar\u0103;<\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s2\"><b>c)<\/b><\/span><span class=\"s1\">\u00a0cazierul fiscal.<\/span><\/p>\n<p class=\"p7\" style=\"text-align: justify;\"><span class=\"s1\"><b>Capitolul II\u00a0\u00cenfiin\u021barea \u0219i \u00eenregistrarea asocia\u021biei de proprietari<\/b><\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s1\"><b>Sec\u0163iunea 1\u00a0Procedura de \u00eenfiin\u021bare \u0219i \u00eenregistrare a asocia\u021biilor de proprietari<\/b><\/span><\/p>\n<p class=\"p5\" style=\"text-align: justify;\"><span class=\"s1\"><b>Articolul 16<\/b><\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s1\">(1)\u00a0Hot\u0103r\u00e2rea proprietarilor privind constituirea asocia\u021biei de proprietari se consemneaz\u0103 prin proces-verbal, \u00eenregistrat \u00een registrul unic al asocia\u021biei de proprietari care cuprinde procesele-verbale ale adun\u0103rii generale, comitetului executiv \u0219i cenzorului\/comisiei de cenzori, semnate de to\u021bi proprietarii care \u0219i-au dat consim\u021b\u0103m\u00e2ntul. Procesul-verbal semnat de c\u0103tre proprietarii care au hot\u0103r\u00e2t, \u00een condi\u021biile\u00a0<\/span><span class=\"s3\">art. 13 alin. (1)<\/span><span class=\"s1\">, constituirea asocia\u021biei de proprietari constituie anex\u0103 la acordul de asociere.<\/span><\/p>\n<p class=\"p5\" style=\"text-align: justify;\"><span class=\"s1\"><b>Articolul 19<\/b><\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s1\">(3)\u00a0Toate asocia\u021biile de proprietari sunt obligate s\u0103 afi\u0219eze, la loc vizibil, pe peretele exterior al imobilului, \u00een imediata apropiere a c\u0103ii de acces \u00een condominiu, sediul \u0219i denumirea asocia\u021biei respective.<\/span><\/p>\n<p class=\"p5\" style=\"text-align: justify;\"><span class=\"s1\"><b>Articolul 20<\/b><\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s1\">(1)\u00a0Fiecare asocia\u021bie de proprietari este obligat\u0103 s\u0103 de\u021bin\u0103 un singur cont bancar.<\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s1\">(2)\u00a0\u00cen vederea pl\u0103\u021bii cotelor de contribu\u021bie la cheltuielile asocia\u021biei de proprietari, datele de identificare ale contului bancar prev\u0103zut la\u00a0<\/span><span class=\"s3\">alin. (1)<\/span><span class=\"s1\">\u00a0se comunic\u0103 tuturor proprietarilor prin afi\u0219are la avizier, odat\u0103 cu lista de plat\u0103 a cheltuielilor asocia\u021biei de proprietari.<\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s1\">(3)\u00a0Prin datele de identificare ale contului bancar men\u021bionate la\u00a0<\/span><span class=\"s3\">alin. (2)<\/span><span class=\"s1\">\u00a0se \u00een\u021belege numele titularului contului, banca la care este deschis contul, sucursala \u0219i codul IBAN.<\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s1\"><b>Sec\u0163iunea a 3-a\u00a0Asocia\u021biile de chiria\u0219i<\/b><\/span><\/p>\n<p class=\"p5\" style=\"text-align: justify;\"><span class=\"s1\"><b>Articolul 23<\/b><\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s1\">Asocia\u021biile de chiria\u0219i se constituie \u0219i se organizeaz\u0103 \u00een conformitate cu prevederile\u00a0<a href=\"http:\/\/legislatie.just.ro\/Public\/DetaliiDocumentAfis\/177159\"><span class=\"s4\">Ordonan\u021bei Guvernului nr. 26\/2000<\/span><\/a>\u00a0cu privire la asocia\u021bii \u0219i funda\u021bii, aprobat\u0103 cu modific\u0103ri \u0219i complet\u0103ri prin\u00a0<a href=\"http:\/\/legislatie.just.ro\/Public\/DetaliiDocumentAfis\/63457\"><span class=\"s4\">Legea nr. 246\/2005<\/span><\/a>, cu modific\u0103rile \u0219i complet\u0103rile ulterioare.<\/span><\/p>\n<p class=\"p5\" style=\"text-align: justify;\"><span class=\"s1\"><b>Articolul 24<\/b><\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s1\">(1)\u00a0Proprietarii condominiilor, persoane fizice sau juridice, destinate \u00een \u00eentregime \u00eenchirierii, \u00een care sunt constituite asocia\u021bii de chiria\u0219i, pot s\u0103 \u00eencredin\u021beze asocia\u021biilor de chiria\u0219i administrarea p\u0103r\u021bilor comune din condominiu.<\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s1\">(2)\u00a0Administrarea p\u0103r\u021bilor comune conform prevederilor\u00a0<\/span><span class=\"s3\">alin. (1)<\/span><span class=\"s1\">\u00a0se face numai \u00een baza unui contract de dare \u00een administrare semnat \u00eentre proprietar \u0219i asocia\u021bia de chiria\u0219i, numai cu acordul majorit\u0103\u021bii chiria\u0219ilor membri ai asocia\u021biei de chiria\u0219i.<\/span><\/p>\n<p class=\"p5\" style=\"text-align: justify;\"><span class=\"s1\"><b>Articolul 25<\/b><\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s1\">(1)\u00a0Asocia\u021biile de chiria\u0219i nu pot efectua modific\u0103ri constructive \u00een condominiu, nu pot schimba destina\u021bia propriet\u0103\u021bii comune din condominiu, nu pot \u00eenstr\u0103ina \u0219i nu pot \u00eenchiria bunurile sau spa\u021biile comune, f\u0103r\u0103 acordul scris al proprietarului, \u00een condi\u021biile legii.<\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s1\">(2)\u00a0Asocia\u021biile de chiria\u0219i desf\u0103\u0219oar\u0103 numai activit\u0103\u021bile prev\u0103zute \u00een contractul de dare \u00een administrare.<\/span><\/p>\n<p class=\"p5\" style=\"text-align: justify;\"><span class=\"s1\"><b>Articolul 26<\/b><\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s1\">Darea \u00een administrare a p\u0103r\u021bilor comune c\u0103tre asocia\u021biile de chiria\u0219i nu aduce nicio atingere drepturilor \u0219i obliga\u021biilor titularului dreptului de proprietate, conform legisla\u021biei \u00een vigoare.<\/span><\/p>\n<p class=\"p7\" style=\"text-align: justify;\"><span class=\"s1\"><b>Capitolul III\u00a0Drepturile \u0219i obliga\u021biile proprietarilor<\/b><\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s1\"><b>Sec\u0163iunea a 2-a\u00a0Obliga\u021biile proprietarilor din condominii<\/b><\/span><\/p>\n<p class=\"p5\" style=\"text-align: justify;\"><span class=\"s1\"><b>Articolul 30<\/b><\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s1\">(1)\u00a0Proprietarii din condominii au obliga\u021bia s\u0103 notifice pre\u0219edintelui orice schimbare intervenit\u0103 \u00een structura \u0219i num\u0103rul membrilor familiei prin deces, c\u0103s\u0103torii sau na\u0219teri, persoanele luate \u00een spa\u021biu, precum \u0219i locatarii\/comodatarii ca urmare a \u00eenchirierii sau a \u00eemprumut\u0103rii locuin\u021bei.<\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s1\">(2)\u00a0Notificarea prev\u0103zut\u0103 la\u00a0<\/span><span class=\"s3\">alin. (1)<\/span><span class=\"s1\">\u00a0se face \u00een scris \u00een termen de 10 zile de la schimbarea intervenit\u0103, de la luarea \u00een spa\u021biu, respectiv de la semnarea contractului de \u00eenchiriere\/comodat.<\/span><\/p>\n<p class=\"p5\" style=\"text-align: justify;\"><span class=\"s1\"><b>Articolul 32<\/b><\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s1\">(2)\u00a0\u00cen cazul condominiilor de tipul imobilelor colective multietajate, modificarea aspectului fa\u021badei se face numai \u00een mod unitar pe \u00eentreg condominiul, indiferent de num\u0103rul asocia\u021biilor de proprietari constituite pe sc\u0103ri sau tronsoane, \u00een baza unei documenta\u021bii tehnice elaborate \u00een condi\u021biile legii, de c\u0103tre arhitec\u021bi cu drept de semn\u0103tur\u0103 \u0219i cu respectarea prevederilor legale \u00een vigoare privind autorizarea execut\u0103rii lucr\u0103rilor de construc\u021bii, regimul monumentelor istorice \u0219i al zonelor protejate, reabilitare termic\u0103 pentru cre\u0219terea performan\u021bei energetice a cl\u0103dirilor \u0219i reabilitarea structural-arhitectural\u0103 a anvelopei acestora pentru cre\u0219terea calit\u0103\u021bii arhitectural-ambientale a cl\u0103dirilor.<\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s1\">(4)\u00a0\u00cen cazul condominiilor cu mai multe tronsoane sau sc\u0103ri legate structural, lucr\u0103rile de consolidare sau modernizare, reabilitare termic\u0103 \u0219i structural-arhitectural\u0103 se vor realiza \u00een mod unitar pentru \u00eentregul ansamblu, cu respectarea \u00eentocmai a caracterului arhitectural al condominiului \u0219i a caracterului ambiental al ansamblului\/zonei de amplasament.<\/span><\/p>\n<p class=\"p5\" style=\"text-align: justify;\"><span class=\"s1\"><b>Articolul 33<\/b><\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s1\">(9)\u00a0Pre\u0219edintele sau administratorul asocia\u021biei de proprietari are obliga\u021bia solicit\u0103rii not\u0103rii \u00een cartea funciar\u0103 a debitelor mai vechi de 3 luni \u0219i care dep\u0103\u0219esc valoarea salariului de baz\u0103 minim brut pe \u021bar\u0103 garantat \u00een plat\u0103. (2)<\/span><span class=\"s1\">\u00a0se \u00eenm\u00e2neaz\u0103 pre\u0219edintelui asocia\u021biei de proprietari \u00een vederea anex\u0103rii acesteia la acordul de asociere.<\/span><\/p>\n<p class=\"p7\" style=\"text-align: justify;\"><span class=\"s1\"><b>Capitolul V\u00a0Organizarea \u0219i func\u021bionarea asocia\u021biilor de proprietari<\/b><\/span><\/p>\n<p class=\"p5\" style=\"text-align: justify;\"><span class=\"s1\"><b>Articolul 46<\/b><\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s1\">(4)\u00a0La asocia\u021biile de proprietari din condominiile care cuprind maximum 10 unit\u0103\u021bi de proprietate imobiliar\u0103, dac\u0103 adunarea general\u0103 hot\u0103r\u0103\u0219te \u00een acest sens, pre\u0219edintele asocia\u021biei de proprietari poate \u00eendeplini \u0219i func\u021bia de administrator \u0219i se constituie urm\u0103toarele organe:<\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s2\"><b>a)<\/b><\/span><span class=\"s1\">\u00a0adunarea general\u0103;<\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s2\"><b>b)<\/b><\/span><span class=\"s1\">\u00a0pre\u0219edintele;<\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s2\"><b>c)<\/b><\/span><span class=\"s1\">\u00a0cenzorul.<\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s1\">(6)\u00a0Nu au dreptul de a fi alese sau numite \u00een func\u021bii de conducere, administrare sau control din cadrul asocia\u021biilor de proprietari persoanele \u00eenrudite p\u00e2n\u0103 la gradul al III-lea cu cei care deja ocup\u0103 aceste func\u021bii.<\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s1\">(7)\u00a0Nu pot fi alese sau numite \u00een func\u021bie de conducere, administrare ori control din cadrul asocia\u021biilor de proprietari persoanele care au suferit condamn\u0103ri, \u00een baza unor hot\u0103r\u00e2ri judec\u0103tore\u0219ti r\u0103mase definitive, pentru infrac\u021biuni de natur\u0103 economico-financiar\u0103.<\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s1\">(8)\u00a0Anterior alegerii sau numirii \u00eentr-o func\u021bie de conducere, administrare ori control din cadrul asocia\u021biilor de proprietari, persoanele candidate trebuie s\u0103 dovedeasc\u0103 \u00een adunarea general\u0103 respectarea prevederilor\u00a0<\/span><span class=\"s3\">alin. (7)<\/span><span class=\"s1\">, pe baza cazierului judiciar eliberat conform prevederilor legale \u00een vigoare \u0219i, \u00een cazul administratorului \u0219i al cenzorului ori, dup\u0103 caz, al membrilor comisiei de cenzori, \u0219i a documentelor care s\u0103 ateste preg\u0103tirea profesional\u0103 \u00een domeniu.<\/span><\/p>\n<p class=\"p5\" style=\"text-align: justify;\"><span class=\"s1\"><b>Articolul 48<\/b><\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s1\">(2)\u00a0Dac\u0103 la prima convocare nu este \u00eentrunit cvorumul necesar de jum\u0103tate plus unu din membrii asocia\u021biei de proprietari, \u00eentrunirea adun\u0103rii generale se suspend\u0103 \u0219i se reconvoac\u0103 \u00een termen de maximum 15 zile de la data primei convoc\u0103ri \u00een condi\u021biile prev\u0103zute la\u00a0<\/span><span class=\"s3\">art. 47.<\/span><\/p>\n<p class=\"p5\" style=\"text-align: justify;\"><span class=\"s1\"><b>Articolul 49<\/b><\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s1\">(3)\u00a0Pentru adoptarea hot\u0103r\u00e2rilor \u00een adunarea general\u0103 a asocia\u021biei de proprietari se au \u00een vedere urm\u0103toarele:<\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s2\"><b>c)<\/b><\/span><span class=\"s1\">\u00a0\u00een situa\u021bia \u00een care un proprietar de\u021bine o cot\u0103-parte indiviz\u0103 de p\u0103r\u021bi comune mai mare de jum\u0103tate din totalul cotelor-p\u0103r\u021bi indivize de proprietate comun\u0103 din condominiu, ponderea voturilor de care el dispune este limitat\u0103, fiind egal\u0103 cu suma ponderii voturilor celorlal\u021bi proprietari;<\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s2\"><b>e)<\/b><\/span><span class=\"s1\">\u00a0un membru al asocia\u021biei de proprietari poate reprezenta cel mult un membru absent, dac\u0103 prezint\u0103 \u00eemputernicire scris\u0103 \u0219i semnat\u0103 de c\u0103tre proprietarii \u00een numele c\u0103rora voteaz\u0103. O copie a \u00eemputernicirii se ata\u0219eaz\u0103 procesului-verbal al \u0219edin\u021bei;<\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s2\"><b>f)<\/b><\/span><span class=\"s1\">\u00a0pre\u0219edintele, membrii comitetului executiv, administratorul, cenzorul\/comisia de cenzori sau alt membru al familiilor acestora nu pot primi mandat pentru a reprezenta un alt proprietar \u00een cadrul adun\u0103rii generale;<\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s2\"><b>h)<\/b><\/span><span class=\"s1\">\u00a0administratorul, reprezentantul administratorului, so\u021bul\/so\u021bia acestuia \u0219i al\u021bi membri ai familiei sale, dac\u0103 sunt membri ai asocia\u021biei de proprietari la care acesta este angajat, nu au drept de vot \u00een probleme referitoare la activitatea administratorului.<\/span><\/p>\n<p class=\"p5\" style=\"text-align: justify;\"><span class=\"s1\"><b>Articolul 50<\/b><\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s1\">Acordul de voin\u021b\u0103 al asocia\u021biei de proprietari se realizeaz\u0103:<\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s2\"><b>a)<\/b><\/span><span class=\"s1\">\u00a0\u00een adunarea general\u0103 a asocia\u021biei de proprietari sau<\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s2\"><b>b)<\/b><\/span><span class=\"s1\">\u00a0\u00een baza declara\u021biilor scrise \u0219i semnate ale fiec\u0103rui proprietar.<\/span><\/p>\n<p class=\"p5\" style=\"text-align: justify;\"><span class=\"s1\"><b>Articolul 55<\/b><\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s1\">(5)\u00a0Administratorul, reprezentantul\/reprezentan\u021bii administratorului, so\u021bul\/so\u021bia, ascenden\u021bii, descenden\u021bii s\u0103i, precum \u0219i cenzorul sau membrii comisiei de cenzori, chiar dac\u0103 sens, \u0219i cu acordul pre\u0219edintelui \u00een func\u021bie, asocia\u021bia de proprietari poate finan\u021ba participarea pre\u0219edintelui la cursuri de perfec\u021bionare acreditate conform legii, referitoare la constituirea, organizarea \u0219i func\u021bionarea asocia\u021biilor de proprietari.<\/span><\/p>\n<p class=\"p5\" style=\"text-align: justify;\"><span class=\"s1\"><b>Articolul 57<\/b><\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s1\">Pre\u0219edintele asocia\u021biei de proprietari are urm\u0103toarele atribu\u021bii:<\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s2\"><b>n)<\/b><\/span><span class=\"s1\">\u00a0afi\u0219eaz\u0103 la avizier hot\u0103r\u00e2rile adun\u0103rii generale \u0219i ale \u0219edin\u021belor comitetului executiv \u00een termen de maximum 7 zile de la data la care au avut loc acestea;<\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s2\"><b>r)<\/b><\/span><span class=\"s1\">\u00a0afi\u0219eaz\u0103 la avizier lista contractelor asocia\u021biei de proprietari cu furnizorii de utilit\u0103\u021bi publice, cu administratorul \u0219i cu personalul angajat sau contractual al asocia\u021biei;<\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s2\"><b>s)<\/b><\/span><span class=\"s1\">\u00a0afi\u0219eaz\u0103 la avizier lista \u0219i datele de contact ale institu\u021biilor cu atribu\u021bii de inspec\u021bie \u0219i control la care pot fi sesizate eventualele nereguli legate de activitatea organelor de conducere ale asocia\u021biei de proprietari, ale administratorului, respectiv ale membrilor asocia\u021biei.<\/span><\/p>\n<p class=\"p5\" style=\"text-align: justify;\"><span class=\"s1\"><b>Articolul 61<\/b><\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s1\">Cenzorul\/Comisia de cenzori a asocia\u021biei de proprietari are, \u00een principal, urm\u0103toarele atribu\u021bii:<\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s2\"><b>e)<\/b><\/span><span class=\"s1\">\u00a0execut\u0103 controale inopinate, \u00eempreun\u0103 cu 2 membri ai comitetului executiv pentru verificarea contabilit\u0103\u021bii \u0219i a activit\u0103\u021bii de casierie, \u0219i consemneaz\u0103 rezultatele controalelor \u00een registrul unic de procese-verbale al asocia\u021biei de proprietari;<\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s2\"><b>f)<\/b><\/span><span class=\"s1\">\u00a0particip\u0103 la adun\u0103rile generale ale asocia\u021biei \u0219i ale comitetului executiv, asigur\u00e2nd legalitatea desf\u0103\u0219ur\u0103rii acestora.<\/span><\/p>\n<p class=\"p5\" style=\"text-align: justify;\"><span class=\"s1\"><b>Articolul 62<\/b><\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s1\">\u00cen vederea facilit\u0103rii comunic\u0103rii dintre autorit\u0103\u021bile administra\u021biei publice locale \u0219i asocia\u021biile de proprietari, pre\u0219edintele asocia\u021biei de proprietari este obligat s\u0103 transmit\u0103, \u00een termen de 30 de zile de la data modific\u0103rii, compartimentelor prev\u0103zute la art. 10 datele de contact actualizate privind pre\u0219edintele, membrii comitetului executiv, membrii comisiei de cenzori sau, dup\u0103 caz, cenzorul \u0219i administratorul.<\/span><\/p>\n<p class=\"p7\" style=\"text-align: justify;\"><span class=\"s1\"><b>Capitolul VI\u00a0Administrarea condominiilor<\/b><\/span><\/p>\n<p class=\"p5\" style=\"text-align: justify;\"><span class=\"s1\"><b>Articolul 64<\/b><\/span><\/p>\n<p class=\"p9\" style=\"text-align: justify;\"><span class=\"s1\">(5)\u00a0Candida\u021bii pentru func\u021bia de administrator trebuie s\u0103 prezinte comitetului executiv al asocia\u021biei de proprietari documentele prev\u0103zute class=\"s2\"><b>b)<\/b><\/span><span class=\"s1\">\u00a0cazierul judiciar care s\u0103 ateste c\u0103 nu a suferit nicio condamnare, prin hot\u0103r\u00e2re judec\u0103toreasc\u0103 r\u0103mas\u0103 definitiv\u0103, pentru o infrac\u021biune de natur\u0103 economico-financiar\u0103.<\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s1\">(7)\u00a0\u00cen vederea \u00eendeplinirii obiectului principal de activitate, persoanele juridice prev\u0103zute la\u00a0<\/span><span class=\"s3\">alin. (6)<\/span><span class=\"s1\">\u00a0au obliga\u021bia ob\u021binerii atestatului \u00een condi\u021biile legii pentru to\u021bi angaja\u021bii acestora care presteaz\u0103 activitatea de administrare a condominiilor.<\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s1\">(8)\u00a0Atestatul se afi\u0219eaz\u0103, prin grija administratorului, la avizier, la data intr\u0103rii \u00een vigoare a contractului de administrare.<\/span><\/p>\n<p class=\"p11\" style=\"text-align: justify;\"><span class=\"s1\"><i>(se pedepseste cu amenda de la 5.000 la 10.000 lei conform art 102 alin (1) lit q) si alin (2) lit d))<\/i><\/span><\/p>\n<p class=\"p5\" style=\"text-align: justify;\"><span class=\"s1\"><b>Articolul 66<\/b><\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s1\">(1)\u00a0Administratorul are, \u00een principal, urm\u0103toarele atribu\u021bii:<\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s2\"><b>n)<\/b><\/span><span class=\"s1\">\u00a0\u00eentocme\u0219te lunar \u0219i depune semestrial la compartimentul specializat \u00een sprijinirea \u0219i \u00eendrumarea asocia\u021biilor de proprietari pe a c\u0103rei raz\u0103 teritorial\u0103 se afl\u0103 condominiul situa\u021bia soldurilor elementelor de activ \u0219i pasiv;<\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s1\">(3)\u00a0Administratorul are obliga\u021bia de a \u021bine eviden\u021be contabile separate pentru fiecare condominiu \u00een parte pe care \u00eel are \u00een administrare.<\/span><\/p>\n<p class=\"p5\" style=\"text-align: justify;\"><span class=\"s1\"><b>Articolul 67<\/b><\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s1\">(2)\u00a0Administratorul este obligat s\u0103 foloseasc\u0103 pentru pl\u0103\u021bile curente \u0219i pentru \u00eencas\u0103ri contul curent al asocia\u021biei prev\u0103zut la\u00a0<\/span><span class=\"s3\">art. 20 alin. (1)<\/span><span class=\"s1\">, la care au acces pentru informare, \u00een condi\u021biile\u00a0<a href=\"http:\/\/legislatie.just.ro\/Public\/DetaliiDocumentAfis\/187262\"><span class=\"s4\">art. 2.184-2.190 din Legea nr. 287\/2009, republicat\u0103<\/span><\/a>, cu modific\u0103rile ulterioare, to\u021bi proprietarii. \u00cen acest cont sunt v\u0103rsate, \u00een termen de 24 de ore de la primirea acestora, toate sumele sau valorile primite \u00een numele sau \u00een contul asocia\u021biei.<\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s1\">(3)\u00a0Contul men\u021bionat la\u00a0<\/span><span class=\"s3\">alin. (2)<\/span><span class=\"s1\">\u00a0poate fi utilizat \u0219i pentru plata cotelor lunare de contribu\u021bie la cheltuielile asocia\u021biei de c\u0103tre proprietari.<\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s1\">(5)\u00a0Prin excep\u021bie de la prevederile\u00a0<\/span><span class=\"s3\">alin. (2)<\/span><span class=\"s1\">, cu acordul adun\u0103rii generale a asocia\u021biei de proprietari, exclusiv \u00een vederea efectu\u0103rii opera\u021biunilor de pl\u0103\u021bi pentru cheltuieli neprev\u0103zute, administratorul poate p\u0103stra \u00een casierie numerar, \u00een limita unui plafon lunar de 1.000 lei.<\/span><\/p>\n<p class=\"p5\" style=\"text-align: justify;\"><span class=\"s1\"><b>Articolul 69<\/b><\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s1\">(1)\u00a0\u00cen cazul schimb\u0103rii administratorului, vechiul administrator este obligat s\u0103 transmit\u0103 noului administrator, \u00een baza unui proces-verbal de predare-primire vizat de pre\u0219edintele asocia\u021biei \u0219i de c\u0103tre cenzor\/comisia de cenzori, \u00eentr-un termen de 5 zile de la \u00eencetarea contractului s\u0103u, totalitatea documentelor, bunurilor \u0219i valorilor aflate \u00een administrarea sa, situa\u021bia financiar-contabil\u0103 a asocia\u021biei \u0219i a fiec\u0103rui proprietar \u00een raport cu asocia\u021bia, situa\u021bia soldurilor elementelor de activ \u0219i de pasiv la data pred\u0103rii. Procesul-verbal cuprinde \u0219i chitan\u021ba de plat\u0103 cu care s-a f\u0103cut ultima \u00eencasare, numele proprietarilor restan\u021bieri, sumele restante, contractele \u00een derulare, pl\u0103\u021bile ce urmeaz\u0103 a fi f\u0103cute dup\u0103 data pred\u0103rii.<\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s1\">(2)\u00a0\u00cen caz de ne\u00eendeplinire a prevederilor prev\u0103zute la\u00a0<\/span><span class=\"s3\">alin. \u0219i prestarea serviciului de canalizare se fac de c\u0103tre acela\u0219i operator;<\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s2\"><b>c)<\/b><\/span><span class=\"s1\">\u00a0to\u021bi proprietarii din condominiu au fost de acord, \u00een scris, cu introducerea \u00een contractul individual de furnizare\/prestare \u00eencheiat \u00een nume propriu a clauzei de sistare\/\u00eentrerupere a serviciului de alimentare cu ap\u0103 \u00een caz de neplat\u0103 a contravalorii serviciului de canalizare;<\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s2\"><b>d)<\/b><\/span><span class=\"s1\">\u00a0solu\u021bia tehnic\u0103 de realizare a bran\u0219amentelor proprii de alimentare cu ap\u0103, precum \u0219i tipul de contoare achizi\u021bionate\/montate de c\u0103tre proprietari au fost avizate de c\u0103tre furnizor.<\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s1\">(4)\u00a0Pentru serviciul public de alimentare cu energie termic\u0103, contractele individuale de furnizare \u00eentre furnizor \u0219i proprietari pot fi \u00eencheiate numai dac\u0103 sunt \u00eendeplinite cumulativ urm\u0103toarele condi\u021bii:<\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s2\"><b>a)<\/b><\/span><span class=\"s1\">\u00a0exist\u0103 bran\u0219amente proprii individuale de alimentare cu energie termic\u0103 realizate \u00eentre re\u021beaua public\u0103 \u0219i re\u021beaua interioar\u0103 a fiec\u0103rei propriet\u0103\u021bi individuale, dotate cu aparate de m\u0103sur\u0103 legale pentru determinarea consumurilor la nivel de proprietate individual\u0103;<\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s2\"><b>b)<\/b><\/span><span class=\"s1\">\u00a0to\u021bi proprietarii din condominiu \u00eencheie contracte individuale de facturare;<\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s2\"><b>c)<\/b><\/span><span class=\"s1\">\u00a0solu\u021bia tehnic\u0103 de realizare a bran\u0219amentelor proprii de alimentare cu energie termic\u0103 \u0219i tipul de contoare achizi\u021bionate\/montate de c\u0103tre proprietar au fost avizate de c\u0103tre furnizor;<\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s2\"><b>d)<\/b><\/span><span class=\"s1\">\u00a0citirea contoarelor individuale \u0219i defalcarea consumurilor individuale \u0219i comune din condominiu se realizeaz\u0103 de c\u0103tre o societate specializat\u0103, avizat\u0103 de autoritatea de reglementare competent\u0103, cheltuielile cu citirea contoarelor fiind suportate de c\u0103tre asocia\u021bia de proprietari.<\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s1\">(5)\u00a0Operatorii economici care furnizeaz\u0103\/presteaz\u0103 servicii de utilit\u0103\u021bi publice c\u0103tre consumatorii alimenta\u021bi\/racorda\u021bi printr-un bran\u0219ament\/racord comun au obliga\u021bia s\u0103 asigure aceste servicii numai dac\u0103 la nivel de condominiu exist\u0103 o asocia\u021bie de proprietari constituit\u0103 \u00een condi\u021biile legii care s\u0103 aib\u0103 calitatea de utilizator, titular de contract, sau dac\u0103 \u00een termen de 180 de zile de la data intr\u0103rii \u00een vigoare a prezentei legi se constituie asocia\u021bii de proprietari conform legii.<\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s1\">(6)\u00a0Contractele de furnizare\/prestare servicii de utilit\u0103\u021bi publice \u00een care asocia\u021bia de proprietari este titular de contract se \u00eencheie pentru to\u021bi consumatorii din condominiu, inclusiv pentru proprietarii din condominiu care nu sunt semnatari ai acordului de asociere \u0219i nu au calitatea de membri ai asocia\u021biei de proprietari.<\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s1\">(7)\u00a0Niciun proprietar nu poate s\u0103 lezeze dreptul altui proprietar de a beneficia de facturarea individual\u0103 \u0219i s\u0103 afecteze furnizarea\/prestarea serviciului pentru \u00eentreg condominiul ca urmare a neachit\u0103rii cotelor de contribu\u021bie ce \u00eei revin la cheltuielile asocia\u021biei de proprietari.<\/span><\/p>\n<p class=\"p5\" style=\"text-align: justify;\"><span class=\"s1\"><b>Articolul 97<\/b><\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s1\">(4)\u00a0Conven\u021biile individuale de facturare a serviciului public de alimentare cu ap\u0103 \u0219i cu energie termic\u0103 \u00eencheiate \u00eentre furnizor \u0219i proprietarii din condominii \u00een calitate de consumatori individuali, anexate la contractul de furnizare\/prestare \u00eencheiat la nivelul asocia\u021biei, se \u00eencheie \u00een una dintre urm\u0103toarele condi\u021bii:<\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s2\"><b>a)<\/b><\/span><span class=\"s1\">\u00a0la propunerea furnizorului serviciilor de utilit\u0103\u021bi publice, cu acordul scris al tuturor proprietarilor din condominiu;<\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s2\"><b>b)<\/b><\/span><span class=\"s1\">\u00a0la solicitarea asocia\u021biei de proprietari, \u00een urma hot\u0103r\u00e2rii adun\u0103rii generale cu acordul scris al tuturor proprietarilor din condominiu.<\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s1\">(5)\u00a0\u00cen situa\u021biile prev\u0103zute la\u00a0<\/span><span class=\"s3\">alin. (4) lit. b)<\/span><span class=\"s1\">\u00a0furnizorii serviciilor de utilit\u0103\u021bi publice sunt obliga\u021bi s\u0103 dea curs solicit\u0103rii asocia\u021biei de proprietari, iar proprietarii suport\u0103 toate costurile suplimentare generate de facturarea individual\u0103 a respectivului serviciu. Costurile suplimentare se includ \u00een facturile lunare individuale.<\/span><\/p>\n<p class=\"p5\" style=\"text-align: justify;\"><span class=\"s1\"><b>Articolul 99<\/b><\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s1\">(3)\u00a0\u00cen cazul factur\u0103rii individuale la nivel de proprietar, conform\u00a0<\/span><span class=\"s3\">art. 95 lit. b)<\/span><span class=\"s1\">, furnizarea serviciilor de utilit\u0103\u021bi publice la nivelul \u00eentregului condominiu nu poate fi \u00eentrerupt\u0103\/sistat\u0103 temporar pentru neplata cotelor de contribu\u021bie la cheltuielile asocia\u021biei de c\u0103tre unul sau mai mul\u021bi proprietari. Furnizarea serviciilor comunitare de utilit\u0103\u021bi publice poate fi \u00eentrerupt\u0103\/sistat\u0103 temporar numai proprietarilor restan\u021bieri, p\u00e2n\u0103 la achitarea facturilor\/sumelor restante, \u00een baza contractului de furnizare\/ prestare \u00eencheiat la nivel individual, respectiv a conven\u021biei individuale de facturare \u00eencheiat\u0103 \u00eentre furnizor \u0219i proprietarii din condominii \u00een calitate de consumatori individuali, anexate la contractul de furnizare\/prestare \u00eencheiat la nivelul asocia\u021biei.<\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s1\">(4)\u00a0\u00cen cazul factur\u0103rii individuale la nivel de proprietar, conform\u00a0<\/span><span class=\"s3\">art. 95 lit. b)<\/span><span class=\"s1\">, propriet\u0103\u021bile individuale din condominii pot fi deconectate\/debran\u0219ate de la serviciile de utilit\u0103\u021bi publice la cerere, \u00een baza solicit\u0103rii \u00een scris a proprietarilor acestora \u0219i cu respectarea prevederilor legale \u00een vigoare, sau \u00een caz de neplat\u0103 a sumelor datorate, \u00een baza contractelor individuale sau a conven\u021biilor individuale de facturare anexate la contractul de furnizare\/prestare \u00eencheiat la nivelul asocia\u021biei, dup\u0103 caz.<\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s1\">(5)\u00a0\u00cen cazul serviciilor de utilit\u0103\u021bi publice care se factureaz\u0103 individual este interzis\u0103 sistarea, limitarea sau \u00eentreruperea furniz\u0103rii\/prest\u0103rii serviciului la nivel de condominiu, pentru neplata facturilor de c\u0103tre unul sau mai mul\u021bi proprietari.<\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s1\">(6)\u00a0Condominiile pot fi deconectate\/debran\u0219ate de la serviciile de utilit\u0103\u021bi publice numai la cererea asocia\u021biei de proprietari, \u00een baza solicit\u0103rii \u00een scris a tuturor proprietarilor din condominiu \u0219i cu respectarea prevederilor legale \u00een vigoare.<\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s1\"><b>Sec\u0163iunea a 2-a\u00a0Contractarea \u0219i facturarea serviciilor de utilit\u0103\u021bi publice \u00een ansamblurile reziden\u021biale<\/b><\/span><\/p>\n<p class=\"p5\" style=\"text-align: justify;\"><span class=\"s1\"><b>Articolul 100<\/b><\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s1\">(1)\u00a0Proprietarii\/Dezvoltatorii ansamblurilor reziden\u021biale au obliga\u021bia s\u0103 asigure furnizarea\/prestarea serviciilor de utilit\u0103\u021bi publice c\u0103tre to\u021bi utilizatorii din ansamblul reziden\u021bial \u00een baza contractelor de furnizare\/prestare \u00eentocmite cu respectarea clauzelor din contractele-cadru elaborate de c\u0103tre autoritatea class=\"s1\">\u00a0asocia\u021biei de proprietari constituit\u0103 la nivelul \u00eentregului ansamblu reziden\u021bial, \u00een cazul \u00een care instala\u021biile aflate \u00een proprietatea sau administrarea furnizorului se bran\u0219eaz\u0103\/ racordeaz\u0103 la instala\u021biile comune interioare ale ansamblului reziden\u021bial aflate \u00een proprietatea comun\u0103 a tuturor proprietarilor din ansamblul reziden\u021bial;<\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s2\"><b>b)<\/b><\/span><span class=\"s1\">\u00a0proprietarului\/dezvoltatorului ansamblului reziden\u021bial, \u00een cazul \u00een care instala\u021biile aflate \u00een proprietatea sau administrarea furnizorului se bran\u0219eaz\u0103\/racordeaz\u0103 la instala\u021biile aflate \u00een proprietatea proprietarului\/dezvoltatorului ansamblului reziden\u021bial;<\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s2\"><b>c)<\/b><\/span><span class=\"s1\">\u00a0asocia\u021biei de proprietari constituit\u0103 la nivelul unui condominiu de tip bloc, \u00een cazul \u00een care instala\u021biile aflate \u00een proprietatea sau administrarea furnizorului se bran\u0219eaz\u0103\/ racordeaz\u0103 la instala\u021biile comune interioare ale condominiului de tip bloc aflate \u00een proprietatea comun\u0103 a tuturor proprietarilor din acel condominiu de tip bloc;<\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s2\"><b>d)<\/b><\/span><span class=\"s1\">\u00a0proprietarului, \u00een cazul \u00een care instala\u021biile aflate \u00een proprietatea sau administrarea furnizorului se bran\u0219eaz\u0103\/ racordeaz\u0103 direct la instala\u021biile interioare ce apar\u021bin propriet\u0103\u021bii individuale.<\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s1\">(3)\u00a0\u00cen situa\u021biile prev\u0103zute la\u00a0<\/span><span class=\"s3\">alin. (2) lit. a)<\/span><span class=\"s1\">\u00a0\u0219i\u00a0<\/span><span class=\"s3\">b)<\/span><span class=\"s1\">, asocia\u021bia de proprietari constituit\u0103 la nivelul ansamblului reziden\u021bial, respectiv proprietarul\/dezvoltatorul ansamblului reziden\u021bial pred\u0103 autorit\u0103\u021bii administra\u021biei publice locale, \u00een termen de 6 luni de la finalizarea lucr\u0103rilor de construc\u021bii, cu titlu gratuit, re\u021belele comune \u0219i terenul aferent p\u00e2n\u0103 la bran\u0219amentele imobilelor din ansamblul reziden\u021bial, \u00een vederea prelu\u0103rii \u00een administrare \u0219i exploatare a acestor re\u021bele de c\u0103tre furnizorul care asigur\u0103 aceste servicii \u00een unitatea administrativ-teritorial\u0103 respectiv\u0103. \u00cen cazul asocia\u021bilor de proprietari constituite la nivelul ansamblurilor reziden\u021biale, decizia de predare \u00een administrare se face cu acordul scris al tuturor proprietarilor.<\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s1\">(5)\u00a0\u00cen situa\u021bia prev\u0103zut\u0103 la\u00a0<\/span><span class=\"s3\">alin. (2) lit. b)<\/span><span class=\"s1\">, proprietarul\/ dezvoltatorul ansamblului reziden\u021bial are obliga\u021bia s\u0103 asigure furnizarea\/prestarea serviciilor de utilit\u0103\u021bi publice c\u0103tre to\u021bi utilizatorii din ansamblul reziden\u021bial \u00een baza contractelor de furnizare\/prestare \u00eentocmite cu respectarea clauzelor din contractele-cadru elaborate de c\u0103tre autoritatea de reglementare competent\u0103.<\/span><\/p>\n<p class=\"p5\" style=\"text-align: justify;\"><span class=\"s1\"><b>Articolul 101<\/b><\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s1\">(1)\u00a0Pre\u021burile \u0219i tarifele practicate pentru furnizarea serviciilor de utilit\u0103\u021bi publice de c\u0103tre proprietarii\/ dezvoltatorii ansamblurilor reziden\u021biale se aprob\u0103 de c\u0103tre autoritatea de reglementare competent\u0103. Ace\u0219tia au obliga\u021bia s\u0103 \u021bin\u0103 eviden\u021ba contabil\u0103 separat\u0103 pentru fiecare serviciu de utilitate public\u0103 furnizat\/prestat.<\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s1\">(2)\u00a0Proprietarii\/Dezvoltatorii ansamblurilor reziden\u021biale au obliga\u021bia s\u0103 monteze la bran\u0219amentele imobilelor contoare de m\u0103surare-\u00eenregistrare a consumurilor, conform legisla\u021biei \u00een vigoare. Determinarea consumurilor care se factureaz\u0103 se face numai prin metoda direct\u0103 \u00een baza indica\u021biilor contoarelor montate la bran\u0219amentul fiec\u0103rui imobil din ansamblul reziden\u021bial.<\/span><\/p>\n<p class=\"p7\" style=\"text-align: justify;\"><span class=\"s1\"><b>Capitolul IX\u00a0Contraven\u021bii \u0219i sanc\u021biuni<\/b><\/span><\/p>\n<p class=\"p5\" style=\"text-align: justify;\"><span class=\"s1\"><b>Articolul 102<\/b><\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s1\">(1)\u00a0Urm\u0103toarele fapte constituie contraven\u021bii, dac\u0103 nu au fost s\u0103v\u00e2r\u0219ite \u00een astfel de condi\u021bii \u00eenc\u00e2t s\u0103 constituie, potrivit legii penale, infrac\u021biuni:<\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s2\"><b>a)<\/b><\/span><span class=\"s1\">\u00a0neconvocarea adun\u0103rii generale, conform prevederilor prezentului act normativ;<\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s2\"><b>b)<\/b><\/span><span class=\"s1\">\u00a0necomunicarea de c\u0103tre proprietar a modific\u0103rii suprafe\u021bei utile c\u0103tre asocia\u021bia de proprietari \u0219i administra\u021bia financiar\u0103 local\u0103;<\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s2\"><b>d)<\/b><\/span><span class=\"s1\">\u00a0nerespectarea de c\u0103tre proprietari a prevederilor\u00a0<\/span><span class=\"s3\">art. 31 alin. (1)<\/span><span class=\"s1\">;<\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s2\"><b>e)<\/b><\/span><span class=\"s1\">\u00a0nerespectarea statutului, a acordului de asociere, precum \u0219i ne\u00eendeplinirea sau dep\u0103\u0219irea atribu\u021biilor de c\u0103tre pre\u0219edinte, membrii comitetului executiv, cenzor\/comisia de cenzori sau de c\u0103tre administrator;<\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s2\"><b>f)<\/b><\/span><span class=\"s1\">\u00a0punerea \u00een pericol de c\u0103tre proprietari a integrit\u0103\u021bii structurale a condominiului sau a altor propriet\u0103\u021bi individuale, precum \u0219i a bunei func\u021bion\u0103ri a instala\u021biilor aferente acestora;<\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s2\"><b>j)<\/b><\/span><span class=\"s1\">\u00a0neluarea m\u0103surilor \u00een scopul constituirii fondului de repara\u021bii sau a fondului de rulment;<\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s2\"><b>k)<\/b><\/span><span class=\"s1\">\u00a0ne\u00eencheierea de c\u0103tre administrator a asigur\u0103rii pentru r\u0103spunderea civil\u0103 profesional\u0103 a administratorului;<\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s2\"><b>l)<\/b><\/span><span class=\"s1\">\u00a0utilizarea cu alt\u0103 destina\u021bie a fondului de rulment sau a fondului de repara\u021bii, altfel dec\u00e2t este prev\u0103zut la\u00a0<\/span><span class=\"s3\">art. 71<\/span><span class=\"s1\">\u00a0\u0219i\u00a0<\/span><span class=\"s3\">72<\/span><span class=\"s1\">;<\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s2\"><b>m)<\/b><\/span><span class=\"s1\">\u00a0utilizarea \u0219i gestionarea veniturilor asocia\u021biei de proprietari, altfel dec\u00e2t este prev\u0103zut la\u00a0<\/span><span class=\"s3\">art. 20<\/span><span class=\"s1\">,\u00a0<\/span><span class=\"s3\">70<\/span><span class=\"s1\">\u00a0\u0219i\u00a0<\/span><span class=\"s3\">74<\/span><span class=\"s1\">;<\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s2\"><b>n)<\/b><\/span><span class=\"s1\">\u00a0neaplicarea sau nerespectarea prevederilor\u00a0<\/span><span class=\"s3\">art. 95-97<\/span><span class=\"s1\">\u00a0\u0219i ale\u00a0<\/span><span class=\"s3\">art. 99<\/span><span class=\"s1\">\u00a0din prezenta lege de c\u0103tre furnizorii serviciilor de utilit\u0103\u021bi publice;<\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s2\"><b>o)<\/b><\/span><span class=\"s1\">\u00a0neaplicarea sau nerespectarea prevederilor prezentei legi de c\u0103tre proprietarii ansamblurilor reziden\u021biale, conform prevederilor\u00a0<\/span><span class=\"s3\">art. 14<\/span><span class=\"s1\">;<\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s2\"><b>p)<\/b><\/span><span class=\"s1\">\u00a0nefurnizarea sau refuzul proprietarilor\/dezvoltatorilor ansamblurilor reziden\u021biale de a furniza\/presta serviciile de utilit\u0103\u021bi publice prin intermediul re\u021belelor aflate \u00een proprietatea acestora c\u0103tre locuin\u021bele sau spa\u021biile cu alt\u0103 destina\u021bie din respectivele ansambluri reziden\u021biale;<\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s2\"><b>q)<\/b><\/span><span class=\"s1\">\u00a0desf\u0103\u0219urarea de c\u0103tre persoane fizice sau juridice a activit\u0103\u021bii de administrare a condominiilor f\u0103r\u0103 \u00eendeplinirea condi\u021biilor prev\u0103zute la\u00a0<\/span><span class=\"s3\">art. 64<\/span><span class=\"s1\">;<\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s2\"><b>r)<\/b><\/span><span class=\"s1\">\u00a0nerespectarea prevederilor\u00a0<\/span><span class=\"s3\">art. 55 alin. (1) lit. s)<\/span><span class=\"s1\">;<\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s2\"><b>s)<\/b><\/span><span class=\"s1\">\u00a0nerespectarea prevederilor\u00a0<\/span><span class=\"s3\">art. 104 alin. (1) lit. g)<\/span><span class=\"s1\">,\u00a0<\/span><span class=\"s3\">h)<\/span><span class=\"s1\">,\u00a0<\/span><span class=\"s3\">i)<\/span><span class=\"s1\">,\u00a0<\/span><span class=\"s3\">m)<\/span><span class=\"s1\">,\u00a0<\/span><span class=\"s3\">p)<\/span><span class=\"s1\">\u00a0\u0219i\u00a0<\/span><span class=\"s3\">q)<\/span><span class=\"s1\">, cu amend\u0103 de la 5.000 lei la 10.000 lei;<\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s2\"><b>e)<\/b><\/span><span class=\"s1\">\u00a0faptele prev\u0103zute la\u00a0<\/span><span class=\"s3\">alin. (1) lit. l)<\/span><span class=\"s1\">,\u00a0<\/span><span class=\"s3\">n)<\/span><span class=\"s1\">, \u0219i\u00a0<\/span><span class=\"s3\">o)<\/span><span class=\"s1\">, cu amend\u0103 de la 4.000 lei la 9.000 lei.<\/span><\/p>\n<p class=\"p7\" style=\"text-align: justify;\"><span class=\"s1\"><b>Capitolul X\u00a0Dispozi\u021bii tranzitorii \u0219i finale<\/b><\/span><\/p>\n<p class=\"p5\" style=\"text-align: justify;\"><span class=\"s1\"><b>Articolul 104<\/b><\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s1\">(1)\u00a0\u00cen termen de 12 luni de la intrarea \u00een vigoare a prezentei legi, asocia\u021biile de locatari din condominiile ale c\u0103ror unit\u0103\u021bi de proprietate individual\u0103 au fost dob\u00e2ndite \u00een proprietate \u00een condi\u021biile legii \u0219i care nu au fost reorganizate \u00een asocia\u021bii de proprietari au obliga\u021bia s\u0103 se reorganizeze \u00een conformitate cu prevederile prezentei legi.<\/span><\/p>\n<p class=\"p5\" style=\"text-align: justify;\"><span class=\"s1\"><b>Articolul 105<\/b><\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s1\">\u00cen termen de 60 de zile de la data intr\u0103rii \u00een vigoare a prezentei legi, pre\u0219edin\u021bii asocia\u021biilor de proprietari sunt obliga\u021bi s\u0103 transmit\u0103 autorit\u0103\u021bilor administra\u021biei publice locale numele \u0219i datele de contact actualizate privind pre\u0219edintele comitetul executiv, comisia de cenzori\/cenzorul \u0219i administratorul.<\/span><\/p>\n<p class=\"p5\" style=\"text-align: justify;\"><span class=\"s1\"><b>Articolul 106<\/b><\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s1\">Persoanele fizice atestate pentru func\u021bia de administrator \u00een conformitate cu prevederile\u00a0<a href=\"http:\/\/legislatie.just.ro\/Public\/DetaliiDocumentAfis\/188165\"><span class=\"s4\">Legii nr. 230\/2007<\/span><\/a>\u00a0privind \u00eenfiin\u021barea, organizarea \u0219i func\u021bionarea asocia\u021biilor de proprietari, cu modific\u0103rile \u0219i complet\u0103rile ulterioare, pot \u00eendeplini func\u021bia de administrator numai dac\u0103, \u00een termen de 12 luni de la intrarea \u00een vigoare a prezentei legi, ob\u021bin certificate de calificare profesional\u0103 care dovedesc calificarea profesional\u0103 pentru a \u00eendeplini ocupa\u021bia de administrator, \u00een conformitate cu prezenta lege.<\/span><\/p>\n<p class=\"p5\" style=\"text-align: justify;\"><span class=\"s1\"><b>Articolul 107<\/b><\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s1\">\u00cen termen de 12 luni de la data intr\u0103rii \u00een vigoare a prezentei legi:<\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s2\"><b>a)<\/b><\/span><span class=\"s1\">\u00a0proprietarii din condominii sunt obliga\u021bi s\u0103 aprobe un regulament al condominiului;<\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s2\"><b>b)<\/b><\/span><span class=\"s1\">\u00a0proprietarii care nu au informat asocia\u021bia de proprietari, \u00een conformitate cu\u00a0<\/span><span class=\"s3\">art. 34 alin. (3)<\/span><span class=\"s1\">, respectiv cu privire la modific\u0103rile suprafe\u021belor construite sau utile efectuate anterior intr\u0103rii \u00een vigoare a prezentei legi, sunt obliga\u021bi s\u0103 comunice asocia\u021biei de proprietari modific\u0103rile suprafe\u021belor respective;<\/span><\/p>\n<p class=\"p4\" style=\"text-align: justify;\"><span class=\"s2\"><b>c)<\/b><\/span><span class=\"s1\">\u00a0pre\u0219edin\u021bii asocia\u021biilor de proprietari sunt obliga\u021bi s\u0103 actualizeze, \u00een baza actelor de proprietate asupra locuin\u021belor \u0219i\/sau spa\u021biilor cu alt\u0103 destina\u021bie dec\u00e2t aceea de locuin\u021b\u0103 din condominiu, toate informa\u021biile privind propriet\u0103\u021bile, suprafe\u021bele \u0219i cotele-p\u0103r\u021bi indivize aferente acestora, \u00een vederea calculului cotelor de contribu\u021bie la cheltuielile asocia\u021biei pentru respectiva locuin\u021b\u0103.<\/span><\/p>\n<p>Ca de obicei, clientilor le stam la dispoztie pentru orice fel de intrebari sau nelamuriri prin intermediul sistemului de tichete din aplicatie!
