Dar cine poate fi pre\u0219edintele asocia\u021biei de proprietari \u0219i care sunt atribu\u021biile acestuia? Despre toate acestea, dar nu numai, vorbim \u00een articolul de fa\u021b\u0103.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Cadrul legal \u0219i condi\u021biile de eligibilitate privitoare la cine poate fi pre\u0219edintele asocia\u021biei de proprietari<\/h2>\n\n\n\n<p>Reglementarea fundamental\u0103 \u00een materie este <strong>Legea nr. 196\/2018<\/strong> privind \u00eenfiin\u021barea, organizarea \u0219i func\u021bionarea asocia\u021biilor de proprietari \u0219i administrarea condominiilor. Aceast\u0103 condi\u021bie exclude, f\u0103r\u0103 echivoc, posibilitatea ca func\u021bia s\u0103 fie ocupat\u0103 de un chiria\u0219 sau de un locatar care nu de\u021bine drepturi de proprietate asupra unei unit\u0103\u021bi locative din condominiu. \u00cen acela\u0219i registru, nu poate fi vorba despre o persoan\u0103 angajat\u0103 \u00een aceast\u0103 func\u021bie, \u00een sensul unui raport de munc\u0103 clasic, similar celui existent \u00een cazul administratorului.<\/p>\n\n\n\n<p>Alegerea pre\u0219edintelui se realizeaz\u0103 \u00een cadrul adun\u0103rii generale, prin votul majorit\u0103\u021bii proprietarilor prezen\u021bi, respectiv jum\u0103tate plus unu din num\u0103rul acestora. Aceast\u0103 procedur\u0103 confer\u0103 legitimitate func\u021biei \u0219i ancoreaz\u0103 decizia \u00een voin\u021ba colectiv\u0103 a comunit\u0103\u021bii. Pre\u0219edintele nu este, a\u0219adar, rezultatul unei numiri formale, ci expresia unui consens, chiar dac\u0103 acesta este unul minimal.<\/p>\n\n\n\n<p>Definirea asocia\u021biei de proprietari ca form\u0103 de asociere autonom\u0103 \u0219i f\u0103r\u0103 scop lucrativ subliniaz\u0103 caracterul participativ al acestei structuri. Din aceast\u0103 perspectiv\u0103, pre\u0219edintele nu se situeaz\u0103 deasupra comunit\u0103\u021bii, ci \u00een interiorul acesteia, ca reprezentant al intereselor comune \u0219i ca interfa\u021b\u0103 \u00eentre proprietari \u0219i ter\u021bi.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Statutul juridic \u0219i natura mandatului<\/h2>\n\n\n\n<p>Func\u021bia de pre\u0219edinte se exercit\u0103 \u00een baza unui mandat acordat de adunarea general\u0103. Pre\u0219edintele r\u0103m\u00e2ne un mandatar al asocia\u021biei, iar responsabilitatea sa deriv\u0103 din \u00eencrederea acordat\u0103 de ceilal\u021bi proprietari.<\/p>\n\n\n\n<p>Legea permite delegarea unor atribu\u021bii c\u0103tre membri ai comitetului executiv, pentru o perioad\u0103 limitat\u0103, de cel mult trei luni pe an. Aceast\u0103 delegare nu produce, \u00eens\u0103, o transferare a r\u0103spunderii juridice. Pre\u0219edintele r\u0103m\u00e2ne responsabil pentru modul \u00een care sunt \u00eendeplinite atribu\u021biile respective, ceea ce impune o aten\u021bie constant\u0103 asupra modului de exercitare a competen\u021belor delegate.<\/p>\n\n\n\n<p>\u00cen cazul \u00eencet\u0103rii mandatului \u00eenainte de termen, comitetul executiv are obliga\u021bia de a convoca, \u00eentr-un interval scurt, o adunare general\u0103 pentru alegerea unui nou pre\u0219edinte. Continuitatea conducerii nu reprezint\u0103 un element op\u021bional, ci o condi\u021bie a func\u021bion\u0103rii legale a asocia\u021biei.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">H2: Rolul \u00een arhitectura institu\u021bional\u0103 a asocia\u021biei<\/h2>\n\n\n\n<p>Structura unei asocia\u021bii de proprietari variaz\u0103 \u00een func\u021bie de dimensiunea acesteia. \u00cen imobilele cu un num\u0103r redus de apartamente, organizarea se concentreaz\u0103 \u00een jurul adun\u0103rii generale, al pre\u0219edintelui \u0219i al cenzorului. \u00cen cazul condominiilor mai mari, apare \u0219i comitetul executiv, iar func\u021bia de control poate fi exercitat\u0103 de o comisie de cenzori.<\/p>\n\n\n\n<p>Indiferent de complexitatea structurii \u0219i de cine poate fi pre\u0219edinte asocia\u021bie de proprietari, at\u00e2t timp c\u00e2t \u00eendepline\u0219te criteriile, acesta ocup\u0103 un rol central. El coordoneaz\u0103 activitatea organelor de conducere \u0219i asigur\u0103 punerea \u00een aplicare a hot\u0103r\u00e2rilor adoptate. Rela\u021bia sa cu ceilal\u021bi membri ai conducerii implic\u0103 colaborare, dar \u0219i o anumit\u0103 autoritate func\u021bional\u0103, derivat\u0103 din rolul de reprezentare.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Atribu\u021biile principale ale pre\u0219edintelui<\/h2>\n\n\n\n<p>Dimensiunea practic\u0103 a func\u021biei se reflect\u0103 \u00een ansamblul atribu\u021biilor stabilite de lege. Acestea contureaz\u0103 un profil complex, care dep\u0103\u0219e\u0219te sfera administrativ\u0103 \u0219i p\u0103trunde \u00een zona rela\u021biilor interumane \u0219i a responsabilit\u0103\u021bii civice.<\/p>\n\n\n\n<p>Pre\u0219edintele reprezint\u0103 asocia\u021bia \u00een raporturile cu ter\u021bii, inclusiv \u00een fa\u021ba instan\u021belor de judecat\u0103. Totodat\u0103, el r\u0103spunde \u00een scris la sesiz\u0103rile \u0219i contesta\u021biile primite, \u00eentr-un termen legal de maximum zece zile. Prin aceste demersuri, pre\u0219edintele contribuie la consolidarea unui climat de \u00eencredere \u0219i la prevenirea tensiunilor interne.<\/p>\n\n\n\n<p>\u00cen plan organizatoric, pre\u0219edintele conduce \u0219edin\u021bele adun\u0103rii generale \u0219i ale comitetului executiv. De asemenea, el \u00eentocme\u0219te documentele necesare convoc\u0103rii \u0219i se asigur\u0103 c\u0103 proprietarii sunt informa\u021bi cu privire la ordinea de zi. Aceast\u0103 atribu\u021bie presupune echilibru \u00eentre fermitate \u0219i \u00een\u021belegerea contextului individual al fiec\u0103rui caz.<\/p>\n\n\n\n<p>De asemenea, pre\u0219edintele are obliga\u021bia de a \u00eentocmi \u0219i actualiza cartea de imobil, document esen\u021bial pentru eviden\u021ba locatarilor \u0219i a situa\u021biei juridice a imobilului.
